Dear Sir or Madam,
Please can you tell me when the speed limit on the A143 changed
from 60 MPH to 30 MPH and what legislation was used to introduce
this limit (e.g Section 82(2)(b) of the Road Traffic Regulation Act
1984).
Please can you also tell me whether the correct legislation was
used initially to introduce the 30 MPH limit and whether
alternative legislation was used to correct any mistakes

Dear Linda Goldsmith,
It has been reported (and proved in court) that Suffolk County
Council incorrectly used Section 82(2)(b) of the Road Traffic
Regulation Act 1984 to impose a 30 MPH on many roads in Suffolk
meaning that the 30 MPH limit was unefforceable and that Suffolk
County Council had to subsequently use an alternative piece of
leglislation to impose a 30 MPH limit that was enforceable.
What I am trying to assertain is was the A143 at Wattisfield
effected by this error, and if so when was the alternative
leglislation used to enable the 30 MPH limit to be enforced.

I am responding to your freedom of information request received on 24 July
2008. Your request was as follows:
Please can you tell me when the speed limit on the A143 changed from 60 MPH
to 30 MPH and what legislation was used to introduce this limit (e.g Section
82(2)(b) of the Road Traffic Regulation Act 1984). Please can you also tell
me whether the correct legislation was used initially to introduce the 30
MPH limit and whether alternative legislation was used to correct any
mistakes.
The 30mph speed limit on the A143 through Wattisfield came into effect on 20
June 1996. The speed limit was made under section 82(2) of the Road Traffic
Regulation Act (RTRA) 1984. At the time the A143 Order was made, Suffolk
County Council made all 30mph under Section 82(2) of the RTRA 1984. Current
advice from the Department of Transport is that all speed limits, other than
those on Restricted Roads should be made by order under Section 84 of the
RTRA 1984 and is now used by SCC. Whilst not best practice speed limit
orders made under Section 82(2) of the RTRA 1984 are legal. There have not
been any amendments made to the Wattisfield 30mph speed limit since it was
first introduced.
