FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 - PROVISION OF INFORMATION
Thank you for your request for information received on 5 November 2008
and I apologise for the delay in responding.
Much of the information you seek is available in the public domain and
would be considered exempt under the Freedom of Information (Scotland)
Act 2002 because it falls under the terms of the Environmental
(Scotland) Information Regulations. However, it is difficult to access
the information due to the complexity of the multiple applications for
the Caltongate scheme and the questions regarding the provider are not
in the public domain.
Answering your specific questions:
The affordable housing planned to be built on council land within the
Caltongate site:
There are two elements to this - there are currently 9 council flats in
221-229 Canongate, as part of the development proposals 4 of these will
be lost and the remaining 5 refurbished;
1 flat will be created in the new build flats to the rear of 221-229
Canongate as a replacement to 1 of the flats lost;
8 new flats will be created on land to the rear of East Market
Street/Cranston Street; 3 of these will replace the units lost at
221-229 Canongate.
Who will build the housing
Mountgrange will build the 8 flats to the rear of East Market
Street/Cranston Street. They will also carry out the development that
results in 1 new and 5 refurbished flats at 221-229 Canongate and the
land behind.
Who will own the housing
The Council will own the 6 flats at 221-229 Canongate. It is currently
intended that Places for People will take responsibility for the 8 flats
at East Market Street/Cranston Street. The current intention is that
this will be a shared equity development. However, the terms of the
Legal agreement that requires the provision of these units is not
specific as to the end provider. The terms of the legal agreement
require that the units be transferred to a Registered Social Landlord
(RSL) or, if there is no agreement within a certain timescale, the
Council, who will then seek an arrangement with an RSL. The legal
agreement is available to view on the Planning and Building Standards
Portal.
